PAIA manual for a private body

A section 51 manual populated with proposed private-body particulars, awaiting incorporation and Information Regulator registration.

Draft v0.2 · particulars proposed; incorporation and registration pending

1. Private-body particulars

Private body: Chainclose (Pty) Ltd, a reserved name pending incorporation. The company registration number and tax/VAT particulars will be inserted from issued records. Head of private body and proposed Information Officer: Therry Martins. Physical, postal and proposed registered address: 20 Mirage Drive, Helderkruin, Johannesburg, 1724, South Africa. Telephone: +27 78 716 0366. Email: privacy@chainclose.co.za. Website: https://chainclose.co.za.

The company, Information Officer registration, monitored mailbox and website are not yet production-qualified. This draft does not represent that a registrable private body already exists under the reserved name.

2. Information Regulator guide

The Information Regulator publishes a guide on exercising PAIA and POPIA rights. The final manual will include the current access route and prescribed forms rather than reproducing a stale copy.

3. Records held

  • Corporate, governance, finance, tax and statutory records.
  • Personnel, contractor and recruitment records where applicable.
  • Customer contracts, orders, support and billing records.
  • Product, security, audit, incident and processing records.
  • Supplier, subprocessor and partner agreements.
  • Intellectual-property, marketing and website records.

4. Records available without a PAIA request

Public website pages, published legal notices, approved security material and customer-owned exports may be available directly. The final voluntary-disclosure schedule will identify exact categories and access methods.

5. Request procedure

  • Use the current prescribed private-body request form.
  • Identify the requester, record, required form of access and the right to be exercised or protected.
  • Provide authority when acting for another person.
  • Pay only prescribed request/access/reproduction fees where applicable.
  • The Information Officer will decide within the statutory process, subject to permitted extension and refusal grounds.

6. Grounds, remedies and availability

Access may be granted, redacted or refused under PAIA's mandatory and discretionary grounds, including protection of personal information, confidential commercial information, safety and privileged records. The final notice will explain complaint/court remedies and where the manual can be inspected or obtained.
